GENESEO – An inmate at Livingston County Jail, already in jail after being arrested in early August for making repeated calls to a person with a court-issued order of protection, is facing new charges after allegedly contacting a protected party more than 200 times by telephone and video chat, according to the Livingston County Sheriff’s Office.
John R. Litolff, 35, of Mount Morris allegedly contacted the protected party between Aug. 6 and 31. It is also alleged that during the conversations, Litolff asked the protected party to drop charges from the incident that he is currently in jail for, the Sheriff’s Office said.
He was arrested Aug. 31 by Sheriff’s Investigator Gene Chicester and charged with felony aggravated criminal contempt and fourth-degree tampering with a witness. The criminal contempt charge is a felony as Litolff had a previous conviction for criminal contempt in September 2018, according to the Sheriff’s Office.
Litolff is incarcerated in Livingston County Jail on felony criminal contempt and aggravated harassment charged and also a parole violation.
Between Aug. 3 and 5 Litolff allegedly called the protected party 67 times and also sent multiple text messages to the party. That investigation began when deputies responded to a residence in the village of Nunda about 12:10 a.m. on Aug. 5 to investigate a violation of a court order. Litolff was later arraigned and remanded to the custody of the Sheriff on $5,000 cash bail or $10,000 bond.
Litolff was processed on the new charges by Central Booking deputies at Livingston County Jail and held for pre-arraignment detention on the new charges. The offenses did qualify for pre-arraignment detention under the state Justice Reform Act.
The District Attorney’s Office recommended that Litolff be released on his own recognizance on the new charges as he was already being held without the chance of bail on the parole violation.
Litolff was later arraigned at Livingston County Centralized Arraignment Part at Livingston County Jail before Town of Nunda Justice Emily Stoufer, who did not release Litolff on his own recognizance based on the parole hold and instead remanded Litolff to the custody of the Sheriff without the chance of bail on the new charges.
Deputies Heather Benjamin and Adam Swanson, both of the Jail Division, assisted with the most recent investigation.
Litolff had entered a guilty plea in Livingston County Court on Sept. 6, 2018, to first-degree criminal contempt, a Class E felony, and was later sentenced to 1-1/3 to 4 years in state prison, according to court records.
Litolff was also charged by Geneseo Police on Jan. 16, 2018, with aggravated harassment for allegedly threatening a person over the telephone, according to Livingston County News archives. The disposition of that case was not available.
In January 2017, he was charged by Geneseo Police with petit larceny and second-degree harassment after being accused of stealing $161.76 in DVDs and pushing a store employee at Walmart, according to the newspaper’s archives. The disposition of that case was not available.
